Términos y Condiciones Canal de Denuncias

Este canal de información se dispone para cumplir con la normativa sobre protección de las personas que informen sobre infracciones del Derecho de la Unión Europea.

Es importante entender que, lo que se trata de preservar mediante dicha normativa, es la protección al informante de posibles represalias en la relación laboral o profesional en cuyo contexto se produzca una infracción de AEROSPACE ENGINEERING GROUP, S.L. (Aerospace Engineering Group), que ésta o sus empleados o directivos hayan podido cometer, en los ámbitos que se indican a continuación, susceptibles de constituir una infracción penal o administrativa grave o muy grave o que afecten al interés general.

Cuando utilizas este canal estás asumiendo que has leído y aceptado las normas de uso que aquí se describen y las condiciones sobre protección de datos que se reflejan en esta misma página Web.

Es un canal seguro y absolutamente confidencial, pudiéndose realizar comunicaciones de manera totalmente anónima siguiendo los pasos descritos en este documento.

Antes de facilitar cualquier información a este canal es importante leer y aceptar las siguientes cuestiones:

1. Este canal está habilitado para informar sobre cualquier incumplimiento y cualquier otra información que recoja un comportamiento irregular, ilícito o delictivo sobre ámbitos relacionados con:

Fraude interno y externo,
Discriminación, acoso laboral y sexual,
Actos de corrupción y soborno, Blanqueo de capitales,
Delitos e infracciones contra la Seguridad Social y la Hacienda Pública,
Infracciones del derecho laboral en materia de Seguridad y Salud en el Trabajo
Incumplimiento de la normativa de protección de la privacidad y de los datos personales, seguridad de las redes y los sistemas de información,
Cualquier otra conducta que implique la comisión de un delito o infracción administrativa grave o muy grave.

2. Este canal no está habilitado para comunicar vulneraciones de normas de derecho privado que regulan las relaciones entre particulares y que no afectan al adecuado funcionamiento de las entidades públicas y privadas, como quejas del servicio, realizar reivindicaciones, difundir rumores, etc.

3. Las informaciones que aportes tienen que basarse en la buena fe, ya que la ley no ampara a quien aporte informaciones falsas o que se hayan obtenido de manera ilícita.

4. La aportación de datos personales es total responsabilidad del informante, quien deberá cumplir con la normativa al respecto. Igualmente es responsabilidad del informante la confidencialidad y custodia de la información proporcionada por Aerospace Engineering Group al código identificativo asignado.

5. Encontrarás información detallada sobre el tratamiento de tus datos personales en la Política de Privacidad del Canal de denuncia.

6. Si lo deseas, puedes aportar información anónimamente; si al hacer la comunicación, te identificas o indicas un domicilio, correo electrónico o lugar seguro a efectos de recibir las notificaciones te enviaremos acuse de recibo de la comunicación en siete días naturales siguientes a su recepción, salvo que ello pueda poner en peligro la confidencialidad de la comunicación.

7. La persona responsable del sistema interno de información-Canal de Denuncia en Aerospace Engineering Group te remitirá la información sobre la denuncia al correo utilizado y codificado con el que podrás consultar el estado de tu comunicación.

8. La denuncia la recibirá la persona Responsable del sistema Interno de Información-Canal de Denuncia. Preservaremos la identidad del informante. Dicha identidad nunca será objeto del derecho de acceso a datos personales y sólo se podrá comunicar a la autoridad judicial, el Ministerio Fiscal o la autoridad administrativa competente exigiendo que en todo caso se impida el acceso por terceros a la misma. La persona a la que se refieran los hechos relatados no será en ningún caso informada de la identidad del informante o de quien, en su caso, haya llevado a cabo la revelación pública.

También preservaremos la información de las personas a las que se refieran los hechos relatados en la comunicación ante el riesgo de que la información, aun con aparentes visos de veracidad, haya sido manipulada, sea falsa o responda a motivaciones que el Derecho no puede amparar. En esos casos la responsabilidad es única y exclusiva del informante, que deberá responder en todo caso, eximiendo a la entidad titular, así como a la gestora del sistema interno de información.

Los accesos a nuestro sistema interno de información están limitados al responsable del Sistema. Trabajarán con esta información, pero ya de forma anonimizada:

La persona instructora asignada.
La persona de los servicios jurídicos consultada, solo si se deben adoptar medidas legales
La persona delegada de Protección de datos.

9. En todo caso respetaremos la presunción de inocencia, el derecho a ser oído y el honor de las personas investigadas. En caso de que abramos una investigación, la duración máxima de la misma no podrá ser superior a tres meses a contar desde la recepción de la comunicación, salvo: casos de especial complejidad que requieran una ampliación del plazo, en cuyo caso, este podrá extenderse hasta un máximo de otros tres meses adicionales o casos específicos que legalmente tengan establecidos otros plazos.

10. Además de este canal interno, puedes usar también, cuando se creen, los canales externos de información ante las autoridades competentes, en este caso, la Autoridad Independiente de Protección del Informante y, en su caso, ante las instituciones, órganos u organismos de la Unión Europea que resulten competentes en cada caso.

11. De cara al cómputo de los plazos previstos en la normativa para la gestión de las informaciones recibidas, no computarán los periodos de cierre de Aerospace Engineering Group, conforme al calendario aplicable a la misma (vacaciones, festivos, días no hábiles en general …)

1. This channel is for reporting any breaches and any other information that constitutes irregular, illegal, or criminal behavior related to:

- Internal and external fraud

-Discrimination, workplace harassment, and sexual harassment

-Acts of corruption and bribery, money laundering

-Crimes and offenses against Social Security and the Public Treasury

-Labor law violations related to Occupational Safety and Health

-Non-compliance with regulations on the protection of privacy and personal data, network and information systems security

-Any other conduct that constitutes a serious or very serious crime or administrative offense.

2. This channel is not for reporting violations of private law regulations governing relationships between individuals that do not affect the proper functioning of public and private entities, such as service complaints, making claims, spreading rumors, etc.

3. The information you provide must be based on good faith, as the law does not protect anyone who provides false information or information obtained illegally.

4. The provision of personal data is the sole responsibility of the informant, who must comply with the relevant regulations. The informant is also responsible for the confidentiality and safekeeping of the information provided to Aerospace Engineering Group using the assigned identification code.

5. You will find detailed information about the processing of your personal data in the Whistleblowing Channel's Privacy Policy.

6. If you wish, you can provide information anonymously. If, when submitting your report, you identify yourself or provide an address, email address, or other secure location for receiving notifications, we will send you an acknowledgment of receipt within seven calendar days of receiving your report, unless doing so could compromise the confidentiality of your information.

7. The person responsible for the Internal Information System – Whistleblowing Channel at Aerospace Engineering Group will send you information about the report to the email address you used for the report, which is encrypted and can be used to check the status of your communication.

8. The report will be received by the person responsible for the Internal Information System – Whistleblowing Channel. We will protect the identity of the whistleblower. This identity will never be subject to the right of access to personal data and may only be disclosed to the judicial authority, the Public Prosecutor's Office, or the competent administrative authority, requiring that in all cases access by third parties be prevented. The person to whom the reported events refer will not, under any circumstances, be informed of the identity of the whistleblower or of whoever, if applicable, made the public disclosure. We will also protect the information of the individuals to whom the reported events refer due to the risk that the information, even with apparent veracity, may have been manipulated, is false, or is motivated by reasons that cannot be protected by law. In such cases, the responsibility lies solely and exclusively with the informant, who must answer in all circumstances, exempting the owning entity, as well as the manager of the internal information system. Access to our internal information system is limited to the System Administrator. The following will work with this information, but in an anonymized form: The assigned investigator. The legal services representative consulted, only if legal action is required. The Data Protection Officer.

9. In all cases, we will respect the presumption of innocence, the right to be heard, and the honor of the individuals under investigation. Should we open an investigation, its maximum duration may not exceed three months from the date of receipt of the notification, except in the following cases: cases of particular complexity requiring an extension, in which case the deadline may be extended for up to three additional months; or specific cases for which other deadlines are legally established.

10. In addition to this internal channel, you may also use, when established, the external channels for reporting to the competent authorities, in this case, the Independent Authority for the Protection of Whistleblowers and, where applicable, to the relevant institutions, bodies, or agencies of the European Union.

11. For the purposes of calculating the deadlines established in the regulations for the processing of received information, periods of closure of Aerospace Engineering Group, according to its applicable calendar (holidays, public holidays, non-working days in general, etc.), will not be included.
