Este canal de información se dispone para cumplir con la normativa del Derecho de la Unión Europea sobre el establecimiento de un sistema obligatorio y voluntario de notificación de sucesos relativos a la seguridad aérea.

Este canal de comunicación ha sido establecido en cumplimiento de los requisitos del Safety Management System (SMS), tal como exige la normativa europea de EASA para organizaciones de mantenimiento aeronáutico (Part-145) y organizaciones de diseño (DOA), que deben implementar sistemas de notificación y gestión de sucesos relacionados con la seguridad operacional. Asimismo, está alineado con las obligaciones de notificación establecidas en el Reglamento (UE) No 376/2014 sobre reporte de sucesos de seguridad aeronáutica
Cuando utilizas este canal estás asumiendo que has leído y aceptado las normas de uso que aquí se describen y las condiciones sobre protección de datos que se reflejan en esta misma página Web.

Es un canal seguro y absolutamente confidencial, pudiéndose realizar comunicaciones de manera totalmente anónima siguiendo los pasos descritos en este documento.
Antes de facilitar cualquier información a este canal es importante leer y aceptar las siguientes cuestiones:

1. Este canal está habilitado para:
 
•    Recibir notificaciones internas de sucesos y condiciones que puedan afectar a la seguridad aeronáutica.
•    Facilitar el cumplimiento del SMS al permitir que el personal identifique y comunique peligros sin temor a repercusiones.
•    Ayudar a la organización a recopilar información de seguridad, analizarla y aplicar acciones de mejora o mitigación de riesgos.

2. Este canal no está habilitado para comunicar vulneraciones de normas de derecho privado que regulan las relaciones entre particulares y que no afectan al adecuado funcionamiento de las entidades públicas y privadas, como quejas del servicio, realizar reivindicaciones, difundir rumores, etc.
 
3. Las informaciones que aportes tienen que basarse en la buena fe, ya que la ley no ampara a quien aporte informaciones falsas o que se hayan obtenido de manera ilícita.
 
4. La aportación de datos personales es total responsabilidad del informante, quien deberá cumplir con la normativa al respecto. Igualmente es responsabilidad del informante la confidencialidad y custodia de la información proporcionada por Aerospace Engineering Group al código identificativo asignado.
 
5. Encontrarás información detallada sobre el tratamiento de tus datos personales en la Política de Privacidad.

6. Si lo deseas, puedes aportar información anónimamente; si al hacer la comunicación, te identificas o indicas un domicilio, correo electrónico o lugar seguro a efectos de recibir las notificaciones te enviaremos acuse de recibo de la comunicación en siete días naturales siguientes a su recepción, salvo que ello pueda poner en peligro la confidencialidad de la comunicación.
 
7. La persona responsable del sistema interno de información-Comunicación de Incidencias de Seguridad en Aerospace Engineering Group te remitirá la información sobre la denuncia al correo utilizado y codificado con el que podrás consultar el estado de tu comunicación.
 
8. La denuncia la recibirá la persona Responsable del sistema Interno de Información-Comunicación de Incidencias de Seguridad. Preservaremos la identidad del informante. Dicha identidad nunca será objeto del derecho de acceso a datos personales y sólo se podrá comunicar a la autoridad judicial, el Ministerio Fiscal o la autoridad administrativa competente exigiendo que en todo caso se impida el acceso por terceros a la misma.
Preservaremos la información de las personas a las que se refieran los hechos relatados en la comunicación ante el riesgo de que la información, aun con aparentes visos de veracidad, haya sido manipulada, sea falsa o responda a motivaciones que el Derecho no puede amparar. En esos casos la responsabilidad es única y exclusiva del informante, que deberá responder en todo caso, eximiendo a la entidad titular, así como a la gestora del sistema interno de información.
Los accesos a nuestro sistema interno de información están limitados al responsable del Sistema. Trabajarán con esta información, pero ya de forma anonimizada:

•    La persona instructora asignada.
•    La persona de los servicios jurídicos consultada, solo si se deben adoptar medidas legales
•    La persona delegada de Protección de datos.

9. Abriremos una investigación, la duración máxima de la misma no podrá ser superior a tres meses a contar desde la recepción de la comunicación, salvo: casos de especial complejidad que requieran una ampliación del plazo, en cuyo caso, este podrá extenderse hasta un máximo de otros tres meses adicionales o casos específicos que legalmente tengan establecidos otros plazos.

10. De cara al cómputo de los plazos para la gestión de las informaciones recibidas, no computarán los periodos de cierre de Aerospace Engineering Group, conforme al calendario aplicable a la misma (vacaciones, festivos, días no hábiles en general …)

Terms and Conditions – Reporting Safety Incidents

This information channel has been established to comply with European Union law regarding the establishment of mandatory and voluntary systems for reporting aviation safety-related events.
This communication channel has been set up in accordance with the requirements of the Safety Management System (SMS), as required by the European Aviation Safety Agency (EASA) regulations for Aircraft Maintenance Organizations (Part-145) and Design Organizations (DOA), which must implement reporting and management systems for operational safety-related events. It is also aligned with the reporting obligations established in Regulation (EU) No 376/2014 on the reporting of aviation safety occurrences.
By using this channel, you acknowledge that you have read and accepted the usage rules described herein, as well as the data protection terms outlined on this same website.
This is a secure and fully confidential channel, and communications can be made completely anonymously by following the steps described in this document.
Before providing any information through this channel, it is important to read and accept the following conditions:
1.    This channel is intended for:
o    Receiving internal notifications of events and conditions that may affect aviation safety.
o    Supporting SMS compliance by allowing personnel to identify and report hazards without fear of repercussions.
o    Assisting the organization in collecting safety information, analyzing it, and implementing improvement or risk mitigation actions.
2.    This channel is not intended for reporting violations of private law that regulate relationships between individuals and do not affect the proper functioning of public or private entities, such as service complaints, claims, spreading rumors, etc.
3.    Information provided must be given in good faith, as the law does not protect anyone who submits false information or information obtained illegally.
4.    The submission of personal data is the sole responsibility of the informant, who must comply with applicable regulations. It is also the informant’s responsibility to maintain the confidentiality and security of the information provided by Aerospace Engineering Group under the assigned identification code.
5.    Detailed information on the processing of your personal data can be found in the Privacy Policy.
6.    You may submit information anonymously; however, if you identify yourself or provide an address, email, or secure contact point to receive notifications, we will acknowledge receipt of your communication within seven calendar days, unless doing so would compromise the confidentiality of the report.
7.    The person responsible for the internal Safety Incident Reporting System at Aerospace Engineering Group will send information about the report to the email used and coded so that you can check the status of your communication.
8.    Reports will be received by the person responsible for the internal Safety Incident Reporting System. The identity of the informant will be preserved. This identity will never be subject to the right of access to personal data and may only be disclosed to the judicial authority, the Public Prosecutor’s Office, or the competent administrative authority, ensuring in all cases that third parties cannot access it.
We will preserve information regarding individuals mentioned in the report, considering the risk that, even if the information appears truthful, it may have been manipulated, be false, or motivated by reasons not protected by law. In such cases, responsibility lies solely with the informant, who will be accountable and exempt the entity owner, as well as the manager of the internal information system, from liability.
Access to our internal information system is limited to the System Manager. The following personnel will work with this information in an anonymized form:
o    Assigned investigation officer.
o    Legal services personnel, only if legal action is required.
o    Data Protection Officer.
9.    An investigation will be opened, and its maximum duration will not exceed three months from the receipt of the communication, except in cases of special complexity requiring an extension, in which case the period may be extended by a maximum of an additional three months, or in specific cases where other legal deadlines apply.
10.    For the calculation of deadlines for managing received information, periods when Aerospace Engineering Group is closed (holidays, non-working days, etc.) will not be counted.
